1. Sweepstakes is open to all legal residents age 21 or older who are homeowners as of the date of the drawing for a winner. 2. Only one name per household/residence shall be eligible. 3. Employees and immediate family members of Energy Saving Exteriors, Inc. ("ESE"), it’s subsidiaries, agents, contracted agents, service or material suppliers are not eligible. 4. The grand prize winner shall be selected from all qualified entries received between August 1, 2008 and January 1, 2010. The prize for this sweepstakes is $25,000 in home improvements which are normally offered by Energy Saving Exteriors, Inc. ("ESE") excluding additional costs related to substitutions and/or changes. Energy Saving Exteriors, Inc. ("ESE") shall not be responsible for damaged wood or structural alterations as part of the installation process. Installation will be at a time convenient for Energy Saving Exteriors, Inc. ("ESE") and the winner(s). 5. Prizes in this promotion are not transferable. 6. The Fair Market Value (FMV) of the prize offered in this promotion is estimated to be approximately $25,000. However, vinyl products are petroleum based and subject therefore to price fluctuations depending on the market conditions at the time of selection of a winner. Energy Saving Exteriors, Inc. ("ESE") is not liable for such differences. Actual Fair Market Value (FMV) will be determined not later than 30 days prior to a winner being selected. 7. Winner(s) do not have to be present at time of drawing to win. The winner(s) will be notified in writing within 10 days after the drawing and will then have 30 days in which to claim their prize. Failure to claim the prize within the allotted time may result in forfeiture of all rights thereto by the claimant. 8. This promotion is void where prohibited by law or restricted by ordinance. Winner(s) are responsible for all taxes and surcharges that may apply as a result of entering a sweepstakes and as a result of winning. Energy Saving Exteriors, Inc. ("ESE") shall provide the winner(s) with an affidavit certifying the The Fair Market Value (FMV) of the prize for tax purposes.
